McCarthy holds degrees from Columbia College and Cardinal Hayes High School in the Bronx neighborhood of New York City. After he graduated from Columbia, he joined the Federal Witness Protection Program as a Deputy United States Marshal. Concurrently, while employed at the US Marshal’s Office, he pursued law studies at New York Law School. Subsequently, he transitioned to the US Attorney’s Office for the Southern District of New York as a paralegal.
In 1986, Andrew was recruited as a prosecutor in the Southern District, where he worked under then-US Attorney Rudy Giuliani. Notably, in 1995, he spearheaded the successful prosecution of Sheikh Omar Abdel-Rahman and eleven accomplices for orchestrating the 1993 World Trade Center bombing and planning subsequent attacks on New York City landmarks. Following this, McCarthy led the satellite office of the Southern District in White Plains, New York, for five years, where he investigated the 1998 bombings of United States embassies in Kenya and Tanzania.
After the September 11th attacks in 2001, Andrew emerged as a pivotal member of a command team of prosecutors tasked with drafting search warrants and coordinating investigations. He concluded his tenure at the prosecutor’s office in 2003. Presently, McCarthy serves as a senior fellow at the Foundation for Defense of Democracies, assuming the role of director of the FDD’s Center for Law and Counterterrorism.
He has provided legal representation for Rudy Giuliani while also contributing as an opinion columnist for the National Review and Commentary. Additionally, he has been a regular contributor to Fox News. Furthermore, he has fulfilled adjunct professor roles at New York Law School and Fordham University School of Law.
